What a dumbass. Not Mike, but the guy who reached that far for it and the
people who pushed him from behind, if there were any. People are friggin
insane when it comes to stuff like this. I tried to catch a drumstick once
and nearly got trampled by half a dozen people. What the heck is wrong with
    people.

Coincidentally, I later went to a Portnoy drum clinic, won a pair of sticks
as a door prize, and had him sign them. All I had to do was stand in line.

I'm not talking about cable. I'm talking about public broadcast. If you want

Really? Slander/libel laws are bad? Laws against unneccessarily inducing
public hysteria/riots are bad? (the old "shouting fire in a theater"
standard). False advertising/fraud laws are bad?

The government is the representative agent of the people. (in theory
anyways) That's why when you see criminal trials, alot of times it's "The
    people vs Joe Blow."

Which part isn't good? That he can't set up a MW transmitter or that he
can't swear, or both? Regarding the transmitter, what happens when two
people want to broadcast on the same frequency?

    >Government is for three purposes only.

    everything it does is bad.

I purchased the platinum package for the Minneapolis show and backstage I
asked Mike if the LA show had been recorded. He said that all the shows are
being recorded. I then asked if they planned on releasing all of them like
Metallica is doing now with their current tour. He answered that they are
talking to their manager about that possibility. No plans for the immediate
    future though.

The first amendment was most certainly not designed to *only*
protect political speech. Read it. It is directly concerned with
freedom of expression through religion, the media ("the press"), and
speech in general. The supreme court has affirmed the idea that the
first amendment applies to all kinds of speech over and over again --
look up examples like the overturning of the ban of "The Catcher in
the Rye," allowing the sale of magazines like Playboy, overturning
the Communications Decency Act, and so on.
Read the Federalist Papers for some really interesting insights
into how much thought went into the founding principles of the
    US government.

    >If you were that concerned about the first ammendment, you'd be out their
    >pinching a fit about the advertising restrictions in the McCain-Feingold
    >campaing finance bill.
    >
The courts have allowed some impositions on speech (e.g. can't
yell "fire" in a crowded theater, obscenity with no artistic or other
merit is not permitted), though it's not yet clear that they will allow
    this particular one.
The first amendment is particularly important when protecting
speech that is not liked by everybody (e.g. indecent speech). There is
no need to protect speech which everyone likes after all.

                                    Steve

P.S. In case you can't find it here is the text of the first amendment:

"Congress shall make no law respecting an establishment of religion,
or prohibiting the free exercise thereof; or abridging the freedom of
speech, or of the press; or the right of the people peaceably to assemble,
and to petition the government for a redress of grievances."

Personally, this seems like an overreaction to me. They've been throwing drumsticks out for what, 15-20 years, and now that this has happened ONCE, they aren't going to do it again?

I like it, I think it shows respect for the fans. It's an overreaction, and is purely symbolic (cymbolic?) but this is prog rock after all. Drumsticks are great (and I have two <gloat>), but nothing compared to the health of this fan. That's totally gut-wrenching.

It seems to me making a call like this speaks more for the band expecting the fanbase to behave like a bunch of idiots (valid enough in this case).

No more DT drum offal doesn't bother me. Hell, I wouldn't mind it if bands in general stopped throwing that crap out. Some of them seem like they're trying to bean audience members on purpose. Friend of mine caught a line drive about a half-inch underneath his eye courtesy of Agalloch's drummer. I saw Raven's drummer, at Powermad several years back, totally nail some poor dude up front for reasons unknown. Keep yer damn sticks to yourselves!

I spoke with MP after that show and he said that it was in fact taped on multi-track *and* video for future release. Whether it will be from Elektra or via Ytsejam Records was not made clear to me, nor whether the audio and/or the video would be released. I'd wager that it will probably be through Ytsejam Records.

There's an official thread stickied to the top of MP's message board that I'm maintaining, and of course there is also the tourography that can be found both on MP's website, as well as the Lines in the Sand website.

Yeah, but why penalize everyone else who'd like a chance at a drumstick (and can act reasonably and safely) for one idiot?

Because it's just a fucking drumstick/drumhead and something nobody should be injured over. Next time, maybe someone gets seriously hurt. Or next time MP and DT get sued because someone breaks an arm or leg in the melee to grab a drumstick.

It's just a fucking drumstick. As William Shatner once said: Get a life!

Exactly. May as well either hand them out after the show or give the first <x> people to get in the door a "claim one drumstick after the show" pass. Sure, it's not as fun, but I can understand MP would have no desire for people to hurt themselves clambering over his drumsticks.
