    Hey there. Okay, first: copyrights.
    It is my understanding of US copyright law that once a piece is performed
    in public, it is protected under copyright. However, since it is often
    difficult to prove when a piece was first performed, the Library of
    Congress will accept a "phonorecord" of the piece to be included
    forevermore in their hallowed halls so that you can't fight the fact that
    the piece was performed (be it live or multitracked). In other words,
    actually mailing 20 bucks to Washington with a tape is a sort of a
    necessary formality. So, don't try copywriting ACoS.

    Second: Does anyone know who is opening for DT this winter? I'd kill to
    see Echolyn again, but that death metal band they had this summer just
    bit ass big time.

    Third: I asked this once before, and got no answer. _ACoS_ says that the
    music to "ACoS" was written by DT. Doesn't that imply that Derek
    co-wrote it and Kevin didn't?

    Fourth: As regards OJ, racism, etc. - enough! Those of us who are
    intelligent enough not to generalize whole groups of people based on
    cosmetic features already know that we won't convert the idiots with a
    couple of e-mailings.

    Hey all:
            Don't you hate it when you type a nice LONG letter, but when you
    attempt to send it, your server tells you that your "disk quota" has been
    exceeded because of all the old 'Jams that you have forgotten to delete are
    taking up too much space? Maybe there is a point to Graham B's "anti-long
    letter" campaign after all. (Just kidding there Graham, my one and only crack
    at you. And to all the rest, I think he learned his lesson. He even had a
    little chuckle himself when he responded to someone's "WARNINGS," though he
    could have said it more tactfully.) Well, enough rambling...ONTO THE GOOD
    STUFF!
            Marc Respass gave his input about the copyrighting of ACOS earlier
    today, and I agree with him. I bet Portnoy copyrighted the song before the ink
    dried. The reason is, all you have to do is write "(C) <year> <so-and-so
    productions>" on any original work and nobody can claim its theirs. If
    somebody does, as soon as you get the legal paperwork done within the allotted
    4 year grace period (red-tape has long lines but at least it is greased by
    absurdly long grace periods), you can sue the pants off of anyone who "steals"
    your work and claims it as their own.
            It has been done (I have seen it with my own eyes), but it slightly
    less than legal, where a artist (of any field) re-copyrights a piece of art in
    subsequent years to avoid filing the necessary paperwork and paying the
    applicable legal fees. This is, as I stated, illegal because copyrights are to
    be issued to original works only, or, as we saw with ACOS '95, updated versions
    by the original artists. Why authors of novels re-copyright works is a little
    beyond me, maybe to re-issue or incorporate it in a "greatest hits" collection.
    Compilers, however, only need to state the copyrighted date (a legal "paying
    respects to") and pay whatever royalties needed. Duplication of lyrics,
    though, is another story altogether. That is why most bands don't print lyrics
    on cover songs...it costs too damn much!
            Most of this comes from personal experience. In high school, I
    animated a 3-D short titled "Everlasting", which was inspired by the music of
    Ennio Morricone's score to _Cinema Paradiso_. Subsequently, I used a generous
    portion of it in the final product (about 2 mins 50 secs). In the attempt to
    win an international award, I needed to "rent" the copyright from him for the
    bargain student price of $300 for two years (normally $500 for pros). I would
    be able to show the film at any international award show and be able to claim
    the prize. However, due to lack of funds (and a major case of stupidity), I
    decided not to "rent" the music. I was then stripped of the 1st place award
    that I had EARNED. (Sure, the music helped...a lot...but it the animation that
    won everybody's heart...I swear!) Oh, well! Life's a BITCH!

            Still sulking after all these years...

    Just thought that I would let you all know that NBC is supporting ACOS...in a
    way.
            Last week on "Caroline in the City" Caroline went to a gay art museum
    where she saw her "stylist." He noticed that she had her hair cut by someone
    else, and they went into that typical "sleeping with someone else/it didn't
    mean a thing" routine. Anyway, she propositioned him to cut her hair out in
    the hall. He replied, (paraphrased) "Sorry...I won't give you a MERCY CUT!"
            BWAH HA HA HA HA HA HA Ha ha...ha...ha?
            OK, maybe it wasn't that funny, but it made me think of all you little
    f**kers!
            Then, tonight on "NewsRadio," they were having a funeral for a rat,
    and the station manager, David, was extrapolating the experience to when his
    cat may die. Phil Hartman's character attempted to comfort him by saying,
    (paraphrased) "Yeats died at the age of 34, and knowing his impending demise,
    he penned the line 'Gather ye rosebuds while ye may.' But then again, it's
    just a damn rat!"
            Ok, enough for now. I will leave you to your racist comments.

            One last thing...if anybody has the passwords to the "information leak"
    test portion of Dune II for IBM, or know where I can find them, I would most
    certainly appreciate it. Thanks.

            One last thing (II)...Mike Bahr's cool! That joke was so funny!

    1) I think what makes DT lyrics so good is the struggle they depict. In
    Voices and the Silent Man John seems to be struggling between
    his spiritual faith and the evidense presented by the material
    world.

    It's not clear who is doing the thought stealing. Is it the church, or
    is it the secular world? Although it is clear that thoughts can be
    manipulated. It is the struggle between the two which
    makes the lyrics interesting. It would quickly become boring
    if they continually wrote about how everything sucks or how
    everything is great.

    My review: WOW!!!

    Pull it out of the packing.. wow!! Great cover, well-done layout, excellent
    printing job. This thing looks more professional than many discs I see in
    the bins at Tower.

    Put it in the cd player.. wow!! The guys are right in your room, the
    recording's so clear. And finally, I have a beautifully clear version of
    them doing Tears. Mike, you've easily outdone yourself on this one (not
    that I had anything against the previous discs.) Folks, if you've been
    putting off ordering AD, don't!

    I'd have to disagree with you on this one. I don't know where you were
    Around Sept 19th, but for more than a week straight I got 2 jams a night
    each with 25 posts in them. And like 90% of htem were "ACOS is killer!"
    "ACOS RULES" nothing but praise. So if DT reads the complaints, they will
    surely read the many more praises.

    WAIT what I said was meant in a sarcastic way such as someone mentioned in a
    jam or two before.

    I WANT TO MAKE IT VERY CLEAR THAT I AM NOT AT ALL IN ANY WAY PREDUJICE TO
    ANY FORM OF RACE, RELIGION, HANDICAP OR PERSONAL BELIEF!!!!!! I have many
    black friends and was even in a band w/ one (kind of a Rage thing).

    But since you mentioned that most jammers seem to share "progressive and
    open-minded ideals" let me share this with you. Although I don't agree with
    Mike C, I understand where he is coming from. He stated something about
    African Americans would stop being persecuted if they would stop acting like
    they were. Think about the fact of how many "Black Power", Malcom X, and
    other racial (against whites) T-shirts there are. In movies, we have hte
    "Panthers" and many others which I have not at all kept up with. Spike Lee,
    for instance, is a great director and film righter but the films he produces
    are IMO 10x more racial than 75% of the American population is on an
    average, to the blacks. If I were to walk around with a shirt that said
    "White Power" on it, I would get jumped. But it is accepted for Black Power
    advertisement to occure everywhere from the elementary schools to the malls
    to the media.
    I will conclude my argument by stating that IMO many, but not all, African
    Americans unconsciously prolong the feeling they have of predujism by
    reminding themselves of it everyday with the apperal they wear, the media
    they surrond htemselves to (movies, TV and music) and the men they look up
    to as great leaders.
    I apologize if I offended anyone, please do not hold it against me.

    Hmm ... why did I get digest 1021 after 1022? EXPLAIN THIS NONSENSE NOW!
    Guess what I found? Some girl I met in my dorm had the radio promotional
    copy of the LIE single (The one in the cardboard case) ... and she gave
    it to me FREE! :) I'm kinda happy now, aside from the fact that my best
    friend just got grounded. Anyway, the copy only has the 5minute edit of
    LIE on it, so it's not much to listen to, but it's not something you can
    buy in stores! (or so I am led to believe) Can we say, "HAPPY!"?

    Oh, and another thing ... I was listening to the live version of
    metropolis off of the Marquee CD, and ... the song really really DRAGS
    .. some songs were just never meant to be played slowly. Reminds me of
    a Roman War party bogged down in mud ... just DRAGS ...

    Ok, one more bitchy comment before I head to the showers: is the
    beginning riff of 6:00 done on guitar, or on that funky distorted
    keyboard that's also used at the beginning of Erotomania? I personally
    think it sounds like the keyboard ... what do you think?

    If DT plays in too big a place then more than likely most the place would
    be empty, yet if they play clubs, more than likely the clubs will be
    packed. So what is better? Seeing a club packed or some other venue
    half or less filled?

    My girlfriend and I went to see Kansas and Alan Parsons at a 15000 person
    outdoor pavillion (Merriweather Post in Columbia Maryland). We had gone to
    see Kansas since we weren't too familiar with Alan Parsons. To our dismay
    Kansas was the opener and they were good. They didn't play long but
    did have an encore. Alan Parsons then came on and they were awesome! They
    are definitely better live than in studio. I recommend seeing them.

    The point of this was even though we got lawn tickets for free (in the

    What does this do to a band's confidence, playing in an empty arena? They
    obvious dont make any money and more than likely lose money. What would
    a band rather see an empty arena of a filled to capacity club?

    !) I wanna point out that I actually _DO_ love ACoS. It is an incredible
    and very powerful song. When I listen to it, stuff sticks out all the
    time as awesome. It is a great song. Sure there are parts that I _THINK_
    that i would change, but espcially with something THAT long, its gonna
    happen. ACoS is a great song. for me, however, it isnt top DT. yet.

    How about an ambiguous reply to your very good question. Yes and no! Take
    the Time is a wonderful example of the quintets' virtuousity and shows
    they can PROG ROCK! However, they have a quiet side and a Metal side. I
    have to say that if TTT did not blow your doors, you may not be enamoured
    of the other material. Mt recommendation? Leave immediately for your
    nearest cd shop and buy DT's entire catalog.Not a gaurantee of happiness,
    but a step in the right direction.

    Hello everybody,
      This is the forst opportunity I've had to write in, but I'd like to start by
    saying this is a good way to get insight on DT, and other prog bands. I would
    like to make a statement that, hopefully, will get people to understand why
    emotions arise strongly with commercial success. I've been an avid prog-fan
    for over 15 years. The first metal band I ever heard was Fates Warning. I
    was also heavily exposed to Yes, Genesis, Queensryche, and other prog-rock/metal
    bands for years. Even though I greatly love the fact that Qqeensryche and DT
    have reach a bigger audience, it might not be a broader one. Sometimes new
    fans kind of erk me!!!!!! Let me explain.

            I heard DT in 1989. Looking at the credits to FW's "Perfect Sym.."
    album. So I immediately went out to look for it. No radio or MTV. DT did
    get some publicity, like an advertisement in a magazine, a couple short inter-
    views, and a review. Queensryche was kind of the same way. I remember a time
    when I would listen to Queensryche at school with a friend, and people either
    laughed and slammed the music, or just didn't care. Then in 1991, SL was
    released, and all of a sudden the same people are at the concerts to see only
    the SL performance. This really pissed the band off, because in Omaha, NE.
    we have a curse of the ZOMBIE PATROL. The same goeas with DT. Even after I
    had IAW for about 2 1/2 months, that whole time people cracked on James' voice.
    Saying, "the drummer needs to play", and "I hate bass players that show off".
    What's funny is that later, when PMU came on the RADIO, everybody liked it.
    Somebody tell me, does radio decide for AMerica what is good? Not for me!!
    So I guess I can relate to some of you who slag the "poseurs", because in Omaha,
    if it weren't for the poseurs, we would have more bands play here. I'm not
    saying that all new fans are poseurs, but be honest. I've seen people who
    meet a band and tell them they are die-hard, loyal fans who love the current
    record, but don't have it and lie about their knowledge of the music. I don't
    think that FW, DT, Queensryche, or any other prog band overplays!!!! It is
    just based more from a European, classical context rather than an American,
    blues-based context. So what!!!!! IMO, most of the "popular" music really
    sucks anyway! I'd rather hear ACoS or Metropolis on the RADIO, rather than
    the Tone Stemple Pilots, Grape Jam, or Scirdona in the music store.
    So I leave EVERYONE with one question: the next concert you attend, look
    around and see if there are people who stop moving at the time changes in a
    DT song. Or, people on the floor that are ZOMBIE's during Promised Land?

    about the guys from the west hoping to be at the malibu- just a word of
    encouragement, i bought my ticjet for their june show the night before. it
    was funny, cause i was at my girlfriend's prom, and in the limo on the radio,
    i hear "dream theater at the malibu june 12th!" i think my girlfriend didn't
    like that i wet my pants on the spot, but i had one PROBLEM! right after the
    prom, i had to board a plane with mom and dad and go to colombia for a
    week.so bummed as hell, i went, and came back 2 days before, figuring it was
    sold out, and i called the day before, and they were like, "oh yeah, we have
    some tickets left." once again, i had to change my pants.

    and to those asking, it's 18 and over to get in, and the malibu is the exit
    off the meadowbrook parkway, right before jones beach. i forget street names
    (i'm from queens), but it's a right at the light and then it's on the left.

    **For those who won't read what is below**
      The sound quality ratings are as follows

      A Excellent Just below the quality of a regular live release
      A- EX- Has a few little problems like uneven mix
      B+ Very Good+ May be muddy in spots but not consistantly

     **Notes**
     1. Tragedy and Comedy are the same show as The Dance of Eternity, except
        they are split into two different packages.
     2. Wake Up and Mind Control are the same show except Mind Control has
        bonus Holland Acoustic 1995 tracks (I think these are Tears & Winter).
     3. Majestic Harmonies contains some of the Majesty demos are filler.
     4. The sound quality of The Dance of Eternity, Lost in the Sky, Wake Up,
        Mind Control, Tragedy, and Comedy are all excellent for boots.
     5. A Kick into a Dream and Consciously Unreal have really good sound
        quality for a boot, and I haven't heard Majestic Harmonies.
     6. I can provide set list information on Wake Up, Lost in the Sky,
        The Dance of Eternity since I own these.
     7. I included audience/soundboard/source info, but I don't agree
        with the person who says that soundboard and FM recordings are
        always better. I have heard some near perfect audience recordings
        and The Dance of Eternity is one of them. I have also heard some
        excellent echolyn audience recordings, and excellent Pink Floyd
        audience tapes. So audience is not always bad, but there is a
        greater margin of error with audience tapes. (Most of the
        really bad recordings I've heard are audience)

                        and as soon as a majority of the money arrives
