All respect for Metallica just went out the window. I was willing to put up
with their new Alternica, but now obviously any kind of artistic intentions
they still had with them went out the window. Its so obvious that they're
in it JUST for the money now. Art is something that should be open to all.

A CD tree is about to go up for the House of Blues concert. I am calling
this "A House I'm Drawn To" since there is a lyric in SFAM that goes with
this. I know there are other titles for this floating around, but I like
this better.
I also know that there are some covers of this floating around. And they
are good. But I want to have a certain type of cover for it. So, I want to
initiate a contest for the cover, with a prize going for the person who can
come up with the coolest cover based on this particular instruction.
I would like to have the front cover of a haunted house. The creepier the
better. Maybe some ghostly images. Maybe some gravestones with Victoria
and Julian written on them. Something like the Bates house (see below)
would be cool...although this particular photo is copyrighted, and may not
provide a good angle. I'm sure someone could find another photo of this
house, or one like it (or better). A night photo would be great.
Preference goes to actual photos, but a good computer image might be cool
too. I was thinking a creepy photo with subtle computer enhancements (like
the HOB logo, gravestones, ...) would be the best. But additions should be
subtle ... not too obvious.
Somewhere in there, if we could put an image (maybe fuzzy and dark) of the
House of Blues logo. Maybe on the gravestones (if you decide to put some on
there).
On the back, some other creepy picture, maybe like the one shown below.
And of course, the usual ... track listing, cool Dream Theater logo, title.
Maybe on the inside cover, a pic of the band from the concert (you can find
that at Bogie's site ... http://dreamtheater.mit.edu/dt-hob.jpg will take
you to the picture.) This picture wouldn't even have to be the whole inside
cover. It could be half the cover with the bottom half containing some cool
text about the concert.
What is the prize? That is yet to be determined. Probably some rare CD of
DT. This might depend on who wins though, and what they already have.
Who will judge? Well, at least me. Maybe Bogie and Cloak. Maybe users at
MP.com.
I hope that a some of you guys will participate in this. The winner can put
their name on the cover somewhere if you like. I know there are some people
out there who really enjoy doing stuff like this.
I could probably do it myself, but I thought it would be more fun to let
someone else have a crack at it. Not to mention that I have a lot going on
right now (between the CDTree, the Petrucci Files website, school, ...).
And the idea of a little contest sounds very interesting.

I have heard Metallica's last two albums, I'd like to know what 'art' Lars
is refering to.
The only thing sickening Lars is that he isn't making money off of this.
This is kind of like the seafood market. Music sells at market value, and
the market value for crap like Load and ReLoad is 'free.'
I would like to see how Metallica plans to support this case in a court of
law. Do they have flyers that were handed out by officials at the
universities that they are suing that say "Don't go to class! Go home and
get Metallica MP3s from Napster!"
The same thing goes for the RIAA's lawsuit against Napster. I admit that
I am not that well versed in Napster (I don't have it) but I have not seen
one thing that indicates that they were going out telling people to trade
illegal MP3s of copywritten material. All they did was provide a means of
trading files, they can't be held responsible because some people use it
for illegal purposes (which I understand is listed as a violation of
Napster's terms of usage). So people distribute songs on MP3, big f'ing
deal. People distribute tapes, CD-Rs, and VHS bootlegs and copies all the
time, and I don't see the MPAA or the RIAA suing the makers of cassette
decks, CD-Rs and VCRs.
Not only should these cases be thrown out of court, but the judge should
reverse judgement and fine Metallica and the RIAA for being idiots and
wasting the judicial system's time.
Then again, this is all just my opinion.

DT also played the beginning peice of "Hot For Teacher" during the Dec 29th. Christmas show in NYC. They were trying to get Derek to sing it, but the only one he ended up singing was "Ice Cream Man".

I love the band, just as much as any other metal fan, but come on. The band members are obviously filling they're bank accounts with royalties everyday, nevermind with the cash they've already poured in. If they're that money hungry, they should release another damn cd, of they're OWN music, and NOT they're music played with an orchestra. (Don't get me wrong, I own both cd's, and love them, I'm just adding fuel to the fire...)

Yeah you're right, but you would be pretty pissed off about Napster if you were Metallica. For small bands I think mp3s are great because they rarely make money from CDs anyway but from tours. The more people they can get hearing their music, the more people come to see them on tour. For bigger, established bands though, Napster is very serious threat. Its a shame though these mp3s. Already CDs are a drop in quality from vinyl, and if mp3s take over CDs, this is yet another drop, all in the name of convenience. On the other hand most regular people don't have good enough equipment (or ears) to notice any difference, so what does it matter? Its just a big predicament (sp?).

Exactly. Encouraging that sort of thing WITH the band's permission would have made it okay. Because as we all know, people who make stuff LOVE it when their creations gets multiplied and traded without any sort of compensation coming back to the source. I guess in Lars' native tongue, "Lars Ulrich" sounds like "Serrano." I can't wait for the next time I give Metallica permission to use one of my photographs for their album cover. Seranno's photographs aren't Lars' "art," and it's not the album covers that draw Metallica a profit. As we all know, lawsuits are USUALLY filed with the permission of the accused. I can't IMAGINE suing someone without TELLING them first. No no no, you misunderstood Lars' point. Lars meant that art should be traded like art, which means you hand someone your painting and they hand you a small animal carved out of ivory. Then you take that ivory animal and trade it to another artist and he plays you a melody on his lute. I agree completely. Yes it does. If you try really hard, you can consume small chunks of ivory and get more vitamins and minerals than eight bowls of Total cereal. In the old days, artists used to eat paint to keep themselves alive. Lars doesn't need money, and neither do I. He's perfectly capable of bringing one of his albums to an art-supply store and trading it for some tasty oil paints. As for me and Serrano, we snack on old negatives. Cause we're ARTISTS, the kind who don't need COMMODITIES.

Hay all, I just put WDADU in my cd-player again (it's been awhile) and I was surprised that I forgot how good this album actually is. I always found Only A Matter of Time to be the best (if not the only really good) song on the album, apart from the Ytsejam (mainly because Charlie's vocals are quite good there). But damn... listen to the intro of LFaGA... it just rocks. Afterlife, TOWHtSTS,... never really paid much attention to these, btu boy was I wrong... BTW I noticed how much the part from 4:30 to 5:42 in LFaGA sound like a heavy Ozrics:-). Anyway, let's give Charlie some credit, he's actually quite good...

To an extent I agree with Metallica, in principle. But I hope they don't pocket the money, a healthy donation to charity would be wishful thinking.
I am not anti mp3, I d/l my fair share, what I am against is these guys that get all these mp3s and never support music and buy an original CD. I know of at least one guy, who has 2000 albums all in mp3, all off the net and he never buys an orginal CD, now how many more like this leech are out there? Thousands I bet.

Regarding the Metallica suit, Lars is just worried about his paycheck. I'll admit that "mainstream" and radio friendly bands may be negatively impacted by unrestricted trading of their music in a Cd quality format. Especially with MP3 walkmen and cd burners all over the market. However,let me present a different viewpoint that many of you should agree with. Surfing around to MP3 sites, like Music In Progress , and the Century Media home has made me buy MORE Cd's. For Prog and other less marketable music , not to mention unsigned bands, MP3's are an incredible tool to expose themselves to potential fans. If you can hear it on the radio and see it on eMpTyV, there probably isn't a need to be able to download entire albums, but I think MP3's give record companies more revenue than they realize, albeit indirectly. Hell, due directly to MIP, I've bought cd's by The Gathering, Blind Guardian, Iced Earth, Vanden Plas,& Ayreon in the last month. And there's a half dozen more on those two sites that I'm looking for now. Maybe I'm just stating the obvious, but I felt I had to say something about the whole deal. The record companies are just suing Napster because that's their only visible target. MP3's are evrywhere and they'll never be able to stop private trading. I'll shut up now.

Define 'freedom.' The only area in which Lars is wrong here is his assumption that art can't be a commodity. The established system of aquiring those commodities works just fine. Just go to the record store and buy it. Don't like the price? Tough shit. It hasn't gone up that much in the 10+ years I've been buying CDs.

The reason that artists don't get compensation for their work is because of things like this trading, be it on cassette tapes, CD-R's, Diamond Rio/Lyra players, or over a T1 or phone line.
With the advent of portable mp3 players, cd-r, and minidisc (even though the quality is questionable), kids are going to stop buying the music. Kids think music should be free, and they'll do whatever they can to make it that way.
