So for any of you who may have been under the impression that all they did was play Metallica stuff that night, that is *not* the case. I won't waste the bandwidth listing the entire setlist, but e-mail me privately and I'll send it to you, if you like. Or you could go to the tourography at Lines in the Sand (http://dreamtheater.mit.edu) and look at all the setlists from the tour so far, which I've got all up to date.

Danke. I was kind of doubting how well Dream Theater could pull this off, but their MOP-extended-cover rules. DT can be very much a metal band when they want to be.

I strongly suggest each reader, listeners, music facility, recording artist, or recording label to take a look and read the material on each of the links above. There are about new proposed rules (you have until March 11 to comment) for webcasting on the internet and copyrights with money going to the RIAA. This is a big push by the recording industry to force out any independent musicians, stations or labels - meaning that the Big 5 will monopolize music on the internet. Without independent radio or labels there will be no source for recognition of artists unless the Big 5 want to promote you. Websites will die as there will be no way for new artists to be found or heard. The big 5 will also control what musical genres there are to listen too - the ones they can make money at. It will make mp3 players useless as there won't be easy sources for music.These regulations will render "music player software" like Winamp, IMNetworks, Apple Itunes, and the likes useless as there will be no webcasting - these regulations are intended to wipe out streaming on the internet. Its time for a class action lawsuit. The regulations will put thousands of workers and businesses out of business. Also note that these fees will be retroactive to 1998. This is the biggest threat to Freedom of Speech! ever seen.
Right now there is very little money being made on the web especially in webcasting. With this type of regulation it will kill any future growth. The immediate issue here is that there is less than 2 weeks to make comments on the findings. As a broadcaster our concern has been to promote independent artists and their music - the overall proposed rates are 30 times higher than those proposed in this arbitration - the minimum rate proposed is $500 per year - which is equivalent to 238 hours of continuous playing to one person (or in other words nine days of radio). Remember now the aggregate tuning hours (for the charges) are per stream basis per single listener. Not only is the $500 minimum fee only good for 9 days of music for one person, its also double the minimum charge that ASCAP and BMI use and 5 times the minimum charge that SESAC charges for an entire year. The yearly fee proposed based on one person listening per year then is equivalent to $20,277 per year - so if on! e of the our streams has 100 listeners on 24 hours a day then the fees that are being proposed are $2,027,000 per year.
So figure it out - no there will be no independent broadcasters on the internet - at least not in the United States. What this is intended to do is force everyone to subscribe to a music listening service which just happen to be owned by those same record companies that have been ripping people off for 50 years. You can darn well bet that if this is allowed to go through there will be no music being played except through the big subscription services - this stuff does not take into consideration the different quality of streams and speeds - all get billed the same.
This is the greatest single action against freedom of speech and action in the United States since the Digital Millennium Recording Act. If a broadcaster is to survive he must use all original content from independent artists - none of which is licensed by the agencies or RIAA. There is literally no way any webcaster can meet the requirements for logging - see the first url for details.
In other words a musician has a hard time now to get his music played on air now due to the monopoly of the big recording agencies and music licensing operations. It will be almost impossible for any up and coming artist to get any airplay - after all the only broadcasters will be the ones owned by the recording conglomerates.
I've watched this developing and have been warning people for the last two years about the tremendous restrictions on free speech this is going to place on American artists. As an independent broadcaster that has spent the last two years building up equipment and bandwidth to a point where we have a decent product, this arbitration ruling between the RIAA and the copyright office of the feds, absolutely threatens the quarter million dollar investment I've put into the operation.
Since we've not been pushing for advertisers in order to get the quality up to a reasonable level we are now faced with a license fee structure that is higher than anything that has ever come before in the broadcast industry - and that is what streaming on the net is - its no different than AM or FM on air - its simple over a different medium but a delivery system no less. Commercial broadcasters usually only pay for ASCAP and BMI licenses to function - webcasters have those fees, SESAC too, and now the RIAA fees - the webcaster gets penalized by adding more listeners - the webcaster can't compete audio quality wise because of the limitations of the internet throughput - yet webcasters have to pay more much much more. Up and coming artist? Want to get airplay? - the only stations left will be the big subscription services. The only solution that we are discussing at the moment internally is all independent music from all independent artists (this will mean that only limited ! music formats will exist as well which is exactly what the major labels want) - we are all for an artist making money; in the case of the RIAA read the fine print - they can use funds for operations (no limitations), and if they cannot distribute a royalty within 3 years they get to keep the money. Nothing in the rulings say they have to find you - so you have no way of knowing if they've collected any revenue. There is NO requirement for accountability. Its more of the same ole same ole.
March 11th is when this goes into effect unless we can stop this. Time is running out...To keep the stations running on the net this has got to stop. THIS IS SERIOUS IF YOU ARE DOING INTERNET RADIO OR LISTEN TO IT!!!!
